Top German state court: PokerStars must pay back €58k in pre-treaty losses

In addition, the Cologne Higher Regional Court’s decision overturned a lower-court decision that was upheld by the Bonn Regional Court. Law firm Dr. Redell Rechtsanwaltsgesellschaft – which represented the player – said that such decisions made by the Bonn Regional Court “should now be a thing of the past”.

One such case, which may be the decision that was overturned, was a player reimbursement case dismissed by the Euskirchen District Court in May 2021. This also concerned an operator based in Malta that was operating in Germany. The dismissal was upheld by the Bonn Regional Court in December that same year. A the time, the judgement was the first such one issued by a German regional court.

Between March 2014 and June 2020, the plaintiff lost €58,517 by playing poker and blackjack on the Pokerstars.eu website. This period was before the Fourth State Treaty on Gambling (GlüNeuRStV) came into force, allowing slots and poker to be offered across Germany, instead of only in Schleswig-Holstein.

Not fully informed on legality of online casino

The law firm said that although the player could have been considered to be breaking the law, this did not mean their complaint was not valid.

The court noted that Pokerstars had not made it clear that online casino games were illegal in most of Germany, meaning that the plaintiff had not been fully informed.

“Contrary to the opinion of the regional court, this information provided by the plaintiff is not unrealistic from the outset, but rather understandable,” said the court. “From the plaintiff’s point of view, there were no compelling indications that spoke for the illegality of the defendant’s range of games.”

In addition, the court said that since the Pokerstars website had been displayed in German, this gave off the impression that the service was legal.

“There was no evidence that online gambling was illegal in Germany – with the exception of a limited offer in Schleswig-Holstein. Rather, the German-language website and the German-language customer service gave the impression of legality,” the court said.

Dr. Redell Rechtsanwaltsgesellschaft noted that the Köln Higher Regional Court is the highest-level court of appeal in Nordrhein-Westfalen and the second-highest in the country. This would auggest that any further appeals of this case would have to be at a federal level.

Earlier this year, the Frankfurt Higher Regional Court ordered an unspecified operator to pay €26,000 in losses, as the plaintiff had gambled with the operator before the GlüNeuRStV came into force.

Pilkington to exit as CEO of KaFe Rocks

Pilkington has led the business as CEO since February 2020, prior to which he served as its vice president of English markets, and before that head of English language markets.

Prior to joining KaFe Rocks in May 2018, Pilkington spent two years at Perform Group in what was his second spell with the business. He spent time as commercial manager for betting at Perform Gaming, and also head of sportsbook for the Dabblebet brand.

During his first spell with Perform, he was commercial manager for betting with consumer brands and portals, as well as strategic campaign manager for betting at Goal.com.

In between these spells, Pilkington was a director at both Simpil Consulting and Omnium, while during his earlier career, he worked for Travel Trade Gazette London, BetRecruit.com, Ladbrokes eGaming, Kelly Services and Imagine Recruitment. 

Pilkington will officially step down as CEO on 31 December.

Letter to staff

He announced his resignation in a letter to staff.

“I’ve spoken often about my passion and love for KaFe Rocks, including as recently as the RocketFest Reunion in October and as I look back and reflect on my time here, it’s clear to me that this passion and love is as strong now as it ever was and I will remain the biggest supporter and cheerleader of the company from the outside,” Pilkington said.

“However, regardless of this passion, I’ve always believed that you’ve got to know when it’s the right time to let go, and I’ve always said from day one that when the right time comes for someone else to take this company forward, then I will stand out of the way because it’s the best thing for the company, and I wish the company nothing but the best ahead.

“It’s also the right time and the right thing to do for me – this role is extremely involved and I’ve always endeavoured to give everything I can to make it a great place to work, but also a successful place of work too. That said, a sustained break to recharge and re-energise whilst looking towards the future will be most welcome.”

Change in ownership

Pilkington added that his departure was not linked with recent strategic changes at KaFe Rocks, which was acquired by Glitnor Group in February this year.

“I want everyone to know that this decision to part ways is something very separate, and I truly believe in the changes that we’ve made acting as the catalyst for long-term future success and growth,” he said.

“I also trust completely in the owners and leadership team to deliver this over the coming months, whilst a new CEO is recruited.”

Sports betting on ballot in California as midterms begin

Voting has indeed already begun, as every county in the Golden state has early voting and drop-off locations. Backed by California’s 78 gaming tribes, Proposition 26 is a retail-first proposal that would legalize sports wagering at tribal casinos and licensed horse racing tracks – imposing a 10% tax on the profits derived from such activities.

This compares with the commercial-sector-supported Proposition 27, which would permit online sports betting. Under the text of the proposed law, such agreements would cost $100m (£87.2m/ €100m) – limiting access to the market from all but the largest operators.

Barring a major upset, both proposals are set to fail according to polling from the Berkeley Institute of Government Studies (IGS). When questioned, 31% of respondents supported Prop 26, with 42% opposed; support for Prop 27 was weaker with 27% for and 53% against.

Bayes Esports enters Canada with Bet365 deal

Canada has just recently opened its doors to single-event sports betting, since a ban was lifted in August 2022 while Ontario became the first canadian province to end its igaming monopoly in April.

Bet365 is one of 49 brands to receive a licence to launch in Ontario.

Without a dependable and secure way of storing the mountains of data operators need to do business, there would be no igaming industry.

Most data centres provide security relevant to their location and customer base but the biggest armour from a security perspective is where your data is hosted, whether this is in a traditional manner, on physical servers or this new wave of storage – in the cloud.

The Key to a global network: security

For obvious reasons, security is high on everyone’s list of requirements when choosing where to host business-critical infrastructure.

Traditionally, telecom operators have had physical data centres and hardware structures, providing services centrally from one place.

This has now evolved into cloud infrastructures of service solutions that go beyond specific jurisdictions.

Keeping up with industry regulations

Gibraltar has long been regarded as one of the most reputable and progressive gaming jurisdictions, with a stringent licensing regime for operators.

With proposed changes to the local Gambling Act expected to be enacted later this year, the scope will be further expanded to ensure that suppliers and peripheral activities associated with the gaming industry are subject to licensing as well.

This will provide a more holistic approach to the sector – with a clear understanding of the important role that technology providers play, and the need to ensure that they are trustworthy.

Startup support

But Gibtelecom’s support for Gibraltar-based businesses goes beyond the tech services it offers.

Developing the product for their partners

For Gibtelecom, and businesses like it, this is only the start. Telecom companies have a fantastic potential to provide cloud services to the gaming industry and expand their clientele. It’s clear Gibtelecom saw this lucrative opportunity early on – so how is it planning to keep this early lead?

It starts with what might be the next great evolution after the cloud: edge computing. By allowing certain tasks to be performed close to where a request begins, instead of in a distant data centre, Gibtelecom hopes to provide faster services than ever for its clients.

The new licensing regime, Shaun notes, will help to facilitate that, providing regulatory certainty for Gibtelecom to provide its cloud gaming and edge services across the globe.

“In the coming months, we will be deploying edge computing services for all of our customers within the gaming industry, should they require it. So, what enables us to do it from, say, a Gibraltar point of view under the new licensing act, is that we have an ATA (Approved Testing Agency) licence.

“This would enable us to push our clients’ content and their website into any country on a serverless edge and complete the solution, without them having to purchase anything else. It is far quicker, more cost-effective and seamless for us and our customers.”

After all, the online gaming sector is evolving at a rate that no one could have predicted. It is now more important than ever to have an infrastructure that is fast, stable, secure and easy to deploy – and Gibtelecom is clearly ahead of the curve.

SpinAway launches in Ontario with GiG

Under the agreement, SpinAway will operate in Ontario using the GiG platform, with players in the regulated market able to access a range of online casino games.

GiG is licensed by the Alcohol and Gaming Commission of Ontario (AGCO) and is therefore authorised to provide its B2B sportsbook and player account management (PAM) platform in the province.

“We’re delighted to have delivered an important milestone in our expansion plans for SpinAway, partnering up once again with the team at GiG to deliver something unique for the Ontarian market, harvesting our confidence in the success of the brand in the region,” a SpinAway spokesperson said.

The launch comes after GiG last week also supported L7 Entertainment enter Ontario via its LuckyDays brand. LuckyDays is now active with its online casino offering in the province on the GiG platform.

This marked the second market launch for GiG and L7 Entertainment, following an earlier roll out in Sweden.

Full House targets Illinois casino launch within next three months

Product and systems testing at the site in Waukegan, Illinois is due to begin before the end of November, with approximately 1,000 slot machines being installed this week. The launch of the new casino will also create hundreds of jobs, with over 400 offers having been made for positions at the facility.

Meanwhile, Full House said the Chamonix project in Cripple Creek, Colorado is progressing well, with president and chief executive Daniel Lee adding that construction reached its ‘topping off’ milestone in September.

“In Waukegan, Illinois, we are installing décor and are preparing for the installation of slot machines this week,” Lee said. “We expect to have our entire slot floor installed and ready for testing before the end of November.

“As with all new casino openings, we have an extensive checklist to complete prior to welcoming our first customers. Therefore, while the company expects to open the casino within the next three months, the precise opening date is still uncertain.

“When The Temporary opens, it will be the only casino in Lake County, Illinois, which has a population of approximately 700,000 and ranks as one of the wealthiest counties in the US.”

“Chamonix’s construction continues at a meaningful pace, with glass now being installed on the façade and drywall within the building. When complete, Chamonix will be one of the larger casino hotels in Colorado and the largest and most luxurious casino hotel in Cripple Creek, which is the primary casino destination for the Colorado Springs market.”

Full House Q3 results

The update on the two facilities came as Full House also posted results for the third quarter of its 2022 financial year, during which revenue declined 12.3% year-on-year to $41.4m (£36.1m/€41.4m).

Casino revenue fell by 8.6% to $29.7m, while food and beverage revenue slipped 4.2% to $6.8m and other revenue, including contracted sports betting, 53.9% to $2.4m. The only area of the business that witnessed growth was hotel, which experienced only a marginal revenue rise to $2.5m.

In terms of geographical performance, The Silver Slipper Casino and Hotel in Illinois led the way with $20.0m in revenue, which was 7.0% down year-on-year, but still one of the most successful quarters in the property’s history.

Revenue at the Rising Star Casino Resort in Indiana also declined 23.8% to $9.6m, while the Bronco Billy’s Casino and Hotel facility in Colorado experienced a 30.2% drop in revenue to $4.4m.

While revenue at the Bronco Billy’s Casino and Stockman’s Casino in Nevada increased by 23.5% year-on-year, revenue from contracted sports betting slipped 31.3% to $1.1m.

Turning to costs, total operating spend for the quarter was $39.0m, up 8.0% from $36.1m last year. Full House also noted $5.9m worth of financial costs, leaving a pre-tax loss of $3.5m, compared to a $4.7m profit at the same point in 2021.

Full House paid $29,000 in income tax, meaning it ended the quarter with a total net loss of $3.6m, in contrast to the $4.6m profit posted in Q3 last year. In addition, adjusted earnings before interest, tax, depreciation and amortization declined 42.7% to $7.8m.
