Swedish industry hopeful election leads to relaxed bonus rules

The country held a general election on Sunday (11 September) to elect members to the Riksdag, with these members then electing a new government. While results are typically clear within a day of voting, a final announcement for this year’s election is not expected until tomorrow – three days after polls closed – as counting continues.

However, projections currently forecast a change in government to a right-leaning coalition, by a single vote. A bloc of the centre-right Moderate Party, the right-wing Sweden Democrats, the Christian Democrats and the Liberal Party is projected to receive 175 seats, one more than the threshold needed for a majority.

If this occurs, a new government would be formed, with the Moderate Party selecting the Prime Minister. This would replace the current government led by the Social Democratic Party.

Gustaf Hoffstedt – secretary general of Swedish trade association Branscheforenigen för Onlinespel  (BOS), and a former Moderate Party member of the Riksdag – said that the industry would welcome a new government.

While the incumbent government passed the gambling Act that ultimately opened up the Swedish licensed online gambling market, it clashed repeatedly with the industry over a number of rules imposed on operators, including a temporary SEK5,000 deposit cap while the industry dealt with Covid-19.

Not enough care

“From a strict gambling regulatory perspective, a development with a new government would be welcome,” Hoffstedt said. “The outgoing Social Democratic minister responsible for gambling policy took the long-awaited initiative to abolish the gambling monopoly in favor of licences, but after that the minister did not show the system enough care.”

In particular, Hoffstedt said the Social Democrat-led coalition was friendly to the country’s former monopolies – such as lottery Svenska Spel and horse racing operator ATG. However, he felt that businesses from abroad did not receive the same treatment.

“Gambling companies with close connections to the Social Democratic Party received positive preferential treatment, international gambling companies were treated stepmotherly and the spirit of consensus that characterized the political parties in the Riksdag was wasted,” he said.

Hoffstedt noted that the current government had allowed Svenska Spel to operate as a lottery and land-based monopoly, while also competing in the regulated sector through its Sport & Casino brand. However, both major parties in the potential new coalition had called for the business to be broken up, meaning this might be on the cards in the future.

“If there is a change of government, it is reasonable to expect that a possible sale of AB Svenska Spel’s subsidiary Sport & Casino will be higher on the agenda, because both the Moderates and the Sweden Democrats, who are both part of the new majority, have advocated just that,” he said.

Marketing moderation

Among the current government’s most recent plans for the industry was a change to the standards that operators must abide by in marketing, which has been called the standard of “adjusted moderation”.

When this was proposed, BOS had welcomed the fact the government had stopped short of harsher proposals like a daytime ad ban, but said the standard was extremely vague and would create uncertainty. Now, Hoffstedt noted that the new Riksdag may not pass the prior government’s proposal to implement this standard. At the same time, he was hopeful that the country’s strict bonus rules – allowing operators to only offer players one bonus, which must be on sign-up – could be relaxed, as the Moderates also proposed.

“It is also reasonable to expect that the tightening of gambling marketing proposed by the outgoing government, so-called ‘adjusted moderation’, will be more difficult to win the Riksdag’s approval,” he said. “And maybe we can also hope for a somewhat more liberal bonus regulation for betting and casino products, but we don’t know much about that yet.”

Premier League confirms return following death of Queen Elizabeth II

Many major British sports events were called off over the weekend of 10-11 September as a mark of respect for the Queen, who passed away on 8 September. The Queen’s funeral has since been announced for 19 September.

The Premier League will return for the weekend on 17-18 September, while two matches will also be played on 16 September. 

Aston Villa will host Southampton on 16 September, while Nottingham Forest play Fulham on the same date.

On 17 September, Wolverhampton Wanderers play Manchester City, Newcastle United faces AFC Bournemouth, and Tottenham Hotspur will host Leicester City. However, the clash between Brighton and Crystal Palace will not take place, having previously been postponed due to now-cancelled industrial strike action on the British rail network.

Brentford will host Arsenal at midday on 18 September, while Everton faces West Ham United later in the day.

The scheduled games between Chelsea and Liverpool, and Manchester United and Leeds United on 18 September will both be postponed and take place at a later date due to events surrounding the Queen’s funeral the following day.

“Following extensive consultation with clubs, police, local safety advisory groups and other relevant authorities, there was no other option but to postpone the three fixtures,” the Premier League said.

“The Premier League would like to thank the UK Football Policing Unit and other police forces across the country, as well as our broadcast partners, for their support during this process, and will continue to liaise with them ahead of the weekend.

“For the matches being played during the period of National Mourning, tributes will be paid to the Queen at Premier League stadiums. 

“New dates for the postponed matches will be announced in due course.”

The announcement comes after the English Football League also announced it would return to its playing schedule from today (13 September), while football will return in Scotland, Wales and Northern Ireland. 

British racing has also returned to normal, though the British Horseracing Authority (BHA) said no meetings will take place on the day of the actual funeral.

Star given 14 days to defend NSW licence after being found “unsuitable”

Adam Bell SC’s report outlined a catalogue of anti-money laundering and social responsibility failings at The Star Sydney stretching back years, manifesting in multiple domains and business practices.

In the report’s analysis of these institutional failings, it stated that the behaviour was the “product of ineffective risk management and governance. It was also the product of a culture which was dysfunctional in relation to the matters investigated in this review, a culture which condoned unethical conduct, prioritised business goals over compliance objectives, courted risk and discouraged bad news.”

An incomplete list of the operator’s misconduct includes successful attempts to circumvent Chinese capital flight laws by deceptively reclassifying gambling spend as hotel expenses on China Union Pay (CUP) cards, lying to banking institutions regarding this payments, allowing an entity with likely links to organised crime to conduct cage operation in the operator’s Star casino, as well as lying to and concealing documents from the state’s regulator, the Independent Liquor and Gaming Authority.  

NICC takes over

The newly empowered NICC has been charged with adjudicating on nature and form of disciplinary actions taken against the casino. NICC chief commissioner, Phillip Crawford, also acts as the chair of the ILGA.

In a statement accompanying the report, Crawford offered an emotional reaction: “The report is, quite frankly, shocking. It provides evidence of an extensive compliance breakdown in key areas of The Star’s business.”

“Not only were huge amounts of money disguised by the casino as hotel expenses, but vast sums of cash evaded anti-money laundering protocols in numerous situations, most alarmingly through Salon 95 – the secret room with a second cash cage.”

Crawford further emphasised the wide-ranging social responsibility failings that were frequent to the casino and institutional in nature:

“In addition to Bell’s analysis of the very real risks of criminal infiltration and the concealment with which senior staff conducted business, the report details cases of individual patrons exposed to gambling harms.”

“The Star offered free alcohol to VIPs as an inducement to gamble and allowed vulnerable patrons to gamble continuously for more than 24 hours at a time, without intervention. These personal accounts are jarring and illustrate how unrestrained gambling can go from entertainment to exploitation.”

Show cause notice

Accompanying the report, the NICC also serve a “show cause” notice to Star, a type of order in which the details of an offense are outlined in a dispute for the receiving party to explain themselves. Star has 14 days to respond to the allegations before disciplinary action is taken.

While it is likely that at least some form of enforcement action will be taken against the casino – which according to the 1992 Casino Control Act could include censuring the operator, imposing a fine up to AU$100m (£59m/ $69.1m/ €69m) and suspending or cancelling the operator’s casino licence – the nature of this action is not yet clear.

The notice states that according the report, “the Star was presently unsuitable to be concerned in or associated with the management and operation of a casino in New South Wales.”

In the days before the release of the report Star halted ASX trading in response to media reports that the casino’s licence was at risk.

ComeOn-affiliated Tulipa Ent receives Dutch licence

It is the twentieth operator to receive a licence from the KSA.

The licence was granted under the Netherlands’ remote gambling act (KOA), which came into force on 1 April 2021 after numerous delays.

The KSA said that it was unaware of the domain Tulipa Ent Limited would operate under, but added that it would be published in the country’s gambling guide – the Kansspelwijzer – once this is known.

According to Tulipa Ent Limited’s company registration, the operator is registered in Malta.

The directors of Tulipa Ent Limited are listed as Cristiano Blanco and Juergen Reutter – the chief product officer and chief executive officer of ComeOn Group, respectively. This suggests that Tulipa is a new Dutch-facing subsidiary of ComeOn.

KSA orders Betworld247 to exit Netherlands or pay weekly fines

The KSA authorised the penalty order following an investigation in which the site was shown to be available to Dutch consumers, without the operator holding the relevant licences. The KSA said that if MKC Limited does not stop illegally offering games of chance it will face a penalty of €28,000 per week, up to a maximum of a €84,000 total.

The order follows research by a KSA supervisor who accessed the site on 24 and 25 May, as well 8 June 2022. The individual was able to create an account, make a deposit and gamble – and noted that no technical measures had been taken to prevents Dutch consumers from taking part.

A player could set their location to Netherlands, with the site including a Dutch language option – but made no reference to Dutch addiction care specialists. The website has seen a significant amount of traffic from Dutch players, including 376,595 unique visits in the period from June 2021 to May 2022.

Acting on behalf of the regulator’s board of directors, the ruling was signed by Ella Seijsener, KSA head of enforcement.

Ongoing crackdown

In a statement accompanying the ruling, the KSA stated its ongoing goal to clampdown on offshore operators in the wake of the launch of the regulated market:

“Since 1 October 2021, licensed providers have been allowed to offer online games of chance in the Netherlands under strict conditions. These conditions are aimed at ensuring a safe legal offer, whereby players are assured of fair play and are protected against gambling addiction. This includes a strict approach to illegal supply.”

The order is the latest in a string of enforcement actions for the regulator, with the KSA most recently issuing a cease and desist order to Sons-of-slots.com operator, LCS Limited.

British sport to return following death of Queen Elizabeth II

England’s Premier League and the English Football League (EFL) postponed all matches over the weekend of 10-11 September, while all games today (12 September) were also called off as a mark of respect for the Queen who died on 8 September.

A host of other sports events due to take place over the weekend were also postponed including all horse racing on 11 September, while the Cycling Tour of Britain cancelled its final three stages in Gloucestershire, Dorset and the Isle of Wight.

In addition, play in the cricket test match between England and South Africa at The Oval in London was called off on 9 September, while the second day of golf’s PGA Championship at Wentworth near London did not take place. 

While Great Britain is still in a period of national mourning, a number of event organisers have confirmed fixtures will return to normal this week, ahead of the Queen’s funeral on 19 September.

The latest round of matches across the EFL – the three leagues immediately below the Premier League – will take place as planned tomorrow (13 September).

“The EFL fixture programme will return as scheduled from Tuesday 13 September, with tributes to be paid to Her late Majesty, Queen Elizabeth II at grounds around the country,” the EFL said.

“A minute’s silence will be held before matches, with black armbands to be worn by participants, flags to be flown at half-mast and the national anthem to be played in stadiums.

“With a national policing plan now in operation, the league and clubs will continue to work with forces in respect of any challenges that may emerge regarding policing of specific fixtures.”

The Scottish Football Association also said it is its intention for the professional game to resume as normal this week.

“Fixtures will go ahead, subject to Police Scotland resourcing, with the caveat that any fixtures under the professional banner be rescheduled if they fall on Monday September 19, the day of Her Majesty’s funeral,” the Scottish FA said.

“This week, as a mark of respect and in keeping with the period of national mourning, home clubs may wish to hold a period of silence and/or play the National Anthem just ahead of kick-off, and players may wish to wear black armbands.”

Football will also return in Wales and Northern Ireland, though the English Premier League is yet to announce whether its planned fixtures will take place this coming weekend. 

British racing has also returned to normal, though the British Horseracing Authority (BHA) said no meetings will take place on the day of the actual funeral.

“This will give everyone involved in British racing the opportunity to mourn Her Late Majesty’s passing and offer thanks for her contribution to our sport and the nation,” the BHA said.

“The fixtures on Monday 19 will therefore be cancelled. Further information will be shared with participants, racecourses and racegoers in the coming days.

“Racing will take place as scheduled throughout the remainder of the intervening period.”

DraftKings announces Steve Aoki as NFT brand ambassador

Aoki will promote the digital marketplace, with a particular focus on DraftKings Reignmakers franchise, a series where users buy and trade NFT player cards to be used in fantasy sports-style contests, where players compete against each other for cash prizes.

Aoki will cooperate on and promote digital collectibles in the DraftKings Marketplace, with Aoki’s first group of products, Aoki 2022 All-Star Access Pass, set to be released on 14 September.
