ACMA launches legal proceedings over illegal online gambling

According to the ACMA, each case relates to the provision of prohibited online gambling services through ‘PPPfish’, a service that was later rebranded as ‘Shuffle Gaming’ and later ‘Redraw Poker’.

These brands, the ACMA alleged, were online poker services – a type of gambling service that is prohibited under section of the Interactive Gambling Act 2001 (IGA).

Launching civil penalty proceedings, the ACMA singled out three parties that were involved with the running and promoting of these services.

Rhys Edward Jones is alleged to have provided these prohibited online gambling services to Australians between March 2020 and March 2021, while Diverse Link Pty delivered these services from March 2021 to the present.

Brenton Lee Buttigieg was also named by the ACMA, with the organisation saying he was involved in promoting and referring customers to those services.

The ACMA alleged that since 2 March 2020, the services provided by Jones and then Diverse Link offered Australians the ability to play poker online for money. 

Players could join poker clubs through a mobile app and purchase chips from separate websites via bank transfer or Bitcoin, which would then credited to their account in the poker club and used to play poker. Chips could be redeemed for money or bitcoin.

The ACMA said that the alleged breaches of the IGA carry a maximum penalty of AU$1.7m (£942,503/€1.1m/US$1.2m) per contravention for individuals, and five times this amount for companies.

As the matter is before the courts, the ACMA said it would not provide any further comment at this time.

Dutch regulator to investigate ads aimed at minors and young people

The KSA stressed that this sort of advertising, which includes promoting bonus offers to young people, is prohibited, adding that young people are “especially vulnerable” to gambling addiction.

The investigation will see the KSA request information from licensees in the Netherlands pertaining to whether they had sent advertisements to minors and young people. This includes emails, bonus offers, push messages and other forms of communication.

The regulator has also appealed for social media sites to report instances of gambling advertising aimed towards minors and young people on their platforms.

Reports can be made through a form on the KSA’s website.

In October 2021 two Dutch trade bodies – Vergunde Nederlandse Online Kansspelaanbieders and VAN Kansspelen – published a draft voluntary code of conduct for advertising, to which operators could choose to adhere after the Netherlands’ online gambling market went live earlier in the month.

This code aims to protect groups that may be prone to experiencing gambling harm, including those under the age of 25, by banning TV and radio stations from advertising bonuses, among other provisions.

The measures could be implemented as soon as 1 April.

Brazilian senators move to create anti-gambling group

The project was created through a single-round vote last week after being approved by Senator Eduardo Girão of Podemos.

“I visited countries, I talked to the academic world, I talked to inspection and control institutions inside and outside Brazil, and I was appalled by what is behind gambling: a very powerful lobby that destroys entire lives and families,” Girão said in introducing the motion.

Senator Angelo Coronel was the lone voter against the motion.

“We can no longer live in this modern world without having the legalization of gaming in Brazil,” he said.

The motion comes as the Senate is set to consider Bill 442/1991, which would legalise  land-based casinos, online gaming, horse racing, slot machines, bingo and jogo de bicho. The bill was passed by the Chamber of Deputies in February.

President Jair Bolsonaro has warned that he plans to veto the bill, however, meaning the Senate would not only need to vote for the bill, but also to override the veto.

Girão said that passage of his motion, however, suggested that the anti-gambling front has enough votes in the Senate to block a veto override.

YGAM and the University of Plymouth to launch loot box education project

The two groups have launched a project, which will see tailored material offered to schools and specialised service providers to provide education on loot boxes.

University of Plymouth academics Dr Helen Lloyd and Dr James Close will work with YGAM to translate knowledge gathered through research into vulnerable groups, including children and people with special educational needs and disabilities, into educational tools.

This will involve a series of engagement and planning workshops, consisting of groups of 15 key people representing a number of organisations, to create a knowledge exchange plan facilitated by the team at the University of Plymouth.

“We are grateful to the University of Plymouth for funding us to work with YGAM and providers of services for vulnerable adults and children in the southwest,” said Lloyd. “Working in partnership with our wider stakeholders to use research-generated knowledge helps us support the important work that they do.”

“Working in this way we can tackle some of our most pressing societal issues while also creating local benefit.”

The 2005 UK Gambling Act does not cover loot boxes. In June 2020 the government announced a call for evidence on how loot boxes impact gambling behaviour, which YGAM contributed to. This ran from September to November 2020 and will form part of the government’s review of the 2005 Gambling Act.

In July 2020, a report from the House of Lords Committee on gambling harm called for loot boxes to be included in the Act.

“We’re delighted to be working with the University of Plymouth team,” said Kev Clelland, director of programme engagement at YGAM. “The study supports our commitment to ensuring all our programmes are evidence-led and external evaluations are used to further enhance our work.

“The subjects of loot boxes and videogame monetisation feature heavily in the public and political conversations on gambling and they also form a key part of our education workshops and our resources.”

The project will begin in May 2022.

Jackpocket moves into New Mexico with lottery app launch

Players in New Mexico can now order and purchase official state lottery tickets through the Jackpocket app, which will operate in the state via a partnership with convenience store brand Circle K.

Lottery games available to consumers include Mega Millions, Powerball, Lotto America, Pick 3, Pick 4, and Roadrunner Cash, with players also having access to features such as joining lottery pools with friends and families.

“Circle K has a long-standing history as one of the top lottery retailers in New Mexico; together, we are excited to bring Jackpocket’s accessibility and convenience to long-time lottery fans and brand-new players alike,” Jackpocket chief executive and founder Peter Sullivan said.

Circle K’s head of North American marketing, Melissa Lessard, added: “Providing the opportunity for customers to order official state lottery tickets with just the tap of a button through the Jackpocket app is yet another example of our commitment to making their lives a little easier every day.”

Jackpocket is also active across Arkansas, Colorado, Minnesota, New Hampshire, New Jersey, Ohio, Oregon, Texas, and Washington DC, while it went live in New York in January this year.

The latest launch comes after Jackpocket last month appointed Jump Ramp Games founder Tony Vartanian to the new role of chief growth and revenue officer.

In this position, Vartanian is tasked with leading new product and revenue opportunities, such as the launch of new game formats and content. In addition, he will lead the business’ geographical expansion into new markets.

Clarion Gaming and the ECA launch Innovation Symposia programme

The announcement took place at Clarion Gaming’s ICE London 2022 show earlier this month.

The Innovation Symposia programme will consist of a series of digital roundtables staged across Europe. These will then be followed by an in-person gathering in Brussels in June.

“The feeling is that the European casino sector, as represented by the ECA and the industry games creators, would benefit by coming together in a series of symposia to plan how the casino sector can come back stronger post-Covid and what it needs from the supplier side to make that happen,” said Stuart Hunter, managing director of Clarion Gaming.

“ICE 2023 has been earmarked as a pivot event in the recovery timetable and the sights gained from the digital and in-person symposia will help determine what the future looks like. We are delighted to be driving this forward in partnership with our colleagues at the ECA who are great supporters of the ICE brand.”

The 2023 edition of ICE London will take place on 7-9 February.

Elys to expand into Ohio with Wright Bet sportsbook deal

Under the deal, Elys will operate multiple sportsbooks across Ohio, with its USBookmaking subsidiary to provide sport wagering services to manage the sportsbook risk and provide bookmaking services.

Should the Ohio Casino Control Commission issue the relevant licence to Elys and Wright Bet, the partnership could offer up to 12 sportsbook locations throughout the state.

“We look forward to expanding our US footprint into the state of Ohio and importantly contribute to the grassroots economy by partnering with local businesses and passionate entrepreneurs like Dr. Kamal Morar (Wright Bet co-founder) and the entire team at Wright Bet,” Elys executive chairman Michele Ciavarella said.

Elys said that the roll-out would be similar to its setup in Washington DC, whereby non-conventional gaming venues such as bars and restaurants could acquire licenses to offer a turnkey sportsbook to patrons within their establishments.

The deal comes after Elys last week posted an increased loss of $15.1m (£11.9m/€14.1m) for 2021, despite a 22.0% rise in revenue.
